Helping Virginians manage the assets of a trust or estate
The responsibilities of executors and administrators after the death of a loved are overwhelming unless you have experienced legal counsel to guide you. For more than 70 years, the trusts and estates team at Jarrell, Hicks & Waldman, PC has helped Virginians in the Spotsylvania and Fredericksburg areas smoothly settle and transfer their loved ones’ property. We understand that distributing assets under the terms of a will or trust is time-consuming and can turn contentious. Attorneys guide administrators and executors of estates
Executors and administrators have the same duties under Virginia law. The only difference is in how they are appointed. If you are named in the will to settle and distribute the estate, you are an executor. If you are appointed by the court to perform those same tasks, you are called an administrator. The duties of an executor or administrator include:
- Identify and protect the assets of the estate
- Pay the debts of the estate
- Distribute the assets in accordance with the will
- File an inventory with the Commissioner of Accounts
- File an accounting with the Commissioner of Accounts
- File the decedent’s final income tax return
- File an income tax return for the estate, if it earned more than $600 in taxable income
- File an estate tax return, if the estate is worth more than $3.5 million
Regardless of the size of the estate, the trusts and estates lawyers at Jarrell, Hicks & Waldman, PC guide you through your duties as an administrator or executor, including ushering the will through the probate process. We serve clients in and around Spotsylvania, Fredericksburg, Thornburg, Corbin, Woodford, Hartwood, Partlow, Richardsville, Locust Grove, Brooke, Ladysmith, Stafford, Lignum, Goldvein, Rappahannock Academy, Garrisonville and Sumerduck.
